Who cares if they had the father's \" src=\"https:\/\/lh4.googleusercontent.com\/-MxLnbnkTJqg\/Uoy199pj-CI\/AAAAAAAADmE\/IsyzTA7JM_k\/s300-no\/telephone-158190_640.png\" width=\"300\" height=\"300\" \/><figcaption class=\"wp-caption-text\">Illegal surveillance. Who cares if they had the father&#8217;s &#8220;permission&#8221;?<\/figcaption><\/figure>\n<p>Well I don&#8217;t\u00a0<em>need<\/em> protection, but there&#8217;s no evidence that the girl who was put under surveillance needed it either. Her father asked for it? Oh, then it must have been ok! It&#8217;s not as if every father in the world would like his daughter to have 24&#215;7 surveillance right?<\/p>\n<p>Let&#8217;s get a few things clear. First, this is a prima facie case of misuse of state machinery &#8211; gross misuse. It&#8217;s not just one police officer, but an entire detachment that was wasted on following this girl and tracking her. Second, no one is interested in what the father wanted. Who is this father? He&#8217;s not her legal guardian since she&#8217;s above 18. So how can he speak for her? He has no right to interfere with her life and take decisions for her. Oh, he has every right to be\u00a0<em>worried<\/em>. That&#8217;s not a problem. Being worried is not a crime. But wanting her to be followed around shows what kind of &#8220;father&#8221; this is.<\/p>\n<p>Third, he also claims she knew about it. Well then, let her come and say so herself! Why is he speaking for her? I presume he&#8217;s not her attorney so what he says has no weight. I wouldn&#8217;t be surprised if he&#8217;s just putting words in her mouth&#8230;like husbands and fathers do all over India every day. But it doesn&#8217;t really matter even if she\u00a0<em>did<\/em> know about it. Let&#8217;s keep in mind that not just her privacy, but that of everyone of her friends and people she met was violated.\u00a0<em>They<\/em> never consented to it did they?<\/p>\n<p>Fourth, people are saying that if she hasn&#8217;t complained and the father doesn&#8217;t have a problem\u00a0(again who\u00a0<i>is<\/i>\u00a0this father fellow?) \u00a0then we should all just sit quiet and forget about the matter. Oh really? Since when did non complaint of a crime be reason to drop a criminal investigation? This is not a civil case where the injured parties have to come forward with a complaint. In criminal investigations, it is the\u00a0<em>state<\/em> who is the prosecutor. Just because a rape victim &#8220;forgives&#8221; her rapist (and even marries him) <a href=\"http:\/\/www.bhagwad.com\/blog\/2013\/rights-and-freedoms\/who-gives-a-damn-if-the-victim-forgives-the-rapist.html\/\">doesn&#8217;t mean we can all drop the whole thing<\/a> with a satisfied smile. The lack of a formal complaint is irrelevant as is evidenced by the fact that <a href=\"http:\/\/timesofindia.indiatimes.com\/india\/Gujarat-snooping-scandal-simmers-case-reaches-Supreme-Court\/articleshow\/26049597.cms\">the Supreme Court is now getting involved<\/a> in the matter. This is basic jurisprudence.<\/p>\n<blockquote class=\"pullquote\"><p>How do you follow someone with a bunch of policemen, surreptitiously get onto the same flight with her, tap her phones and those of her family and friends and call it &#8220;protection&#8221;. Did the nuances of English change when I wasn&#8217;t looking?<\/p><\/blockquote>\n<p>Fifth, it&#8217;s not just about the snooping or the misallocation of police resources. It&#8217;s about the\u00a0<em>scale<\/em>. One can make a case for putting a constable (or a couple of them) on a case to provide protection for a person who might be at risk. Even that needs a reasonable threat assessment, not just the concern of some random father. But by all accounts here we have an entire section of police following her, getting on planes, and monitoring her calls. And not just hers! The phone lines of those she knew, her family and her friends were tapped as well! So let&#8217;s pause for a moment and appreciate the breadth of the issue involved. They didn&#8217;t take just a harmless precaution. They systematically and ham handedly violated the privacy and rights of everyone whom the girl came into contact with.<\/p>\n<p>As it is, India has one of the lowest police\/population ratios in the world. The more you look at it, the more absurd this criminal waste of manpower becomes.<\/p>\n<p>Sixth, for god&#8217;s sake keep the Congress out of this. When I lambasted the Congress <a href=\"http:\/\/www.bhagwad.com\/blog\/2013\/politics\/encourage-violence-ban-free-speech-utterly-spineless.html\/\">for Section 66A<\/a>, <a href=\"http:\/\/www.bhagwad.com\/blog\/2011\/politics\/lokpal-government-claims-that-no-one-can-criticize-them.html\/\">the Lokpal bill<\/a>, for <a href=\"http:\/\/www.bhagwad.com\/blog\/2013\/politics\/rti-criminals-in-elections-now-they-want-to-tear-up-the-consitution.html\/\">introducing terrible bills in Parliament<\/a>, and\u00a0<a href=\"http:\/\/www.bhagwad.com\/blog\/2010\/politics\/how-to-smuggle-a-nuclear-liability-bill.html\/\">cheating with the nuclear liability bill<\/a>, no one brought up the BJP. The misdemeanors of the two parties are entirely separate. By all means we can (and should) talk about the corruption of the UPA, but this particular incident is about the BJP and specifically about Modi.
